Terms of Use

These Terms of Use ("Terms") govern your use of Chekiraj, the website and online service at chekiraj.net (the "Platform"), operated by [буде доповнено] ("Chekiraj", "we", "us"). By creating an account or using the Platform you agree to these Terms, together with our Privacy Policy, Cookie Policy, Refund and Cancellation Policy and Community and Review Guidelines, which form part of these Terms.

Who we are

What Chekiraj is

Chekiraj is an online booking platform. It lets businesses that work by appointment (such as salons, clinics, studios, sports venues and rentals) publish a profile, their services and their free times, and lets clients find these businesses and book appointments online.

• Chekiraj is an intermediary. The service you book is provided by the business, not by Chekiraj. The contract for that service is between you and the business.
• Clients do not pay for services through Chekiraj. You pay the business directly, as agreed with the business. Chekiraj takes no commission on services.
• Prices, descriptions, durations, cancellation rules and other details of services are entered by the businesses themselves. They are informational, and the business is responsible for their accuracy.
• Chekiraj is free for clients. Businesses pay a subscription, as described in these Terms and on the pricing page.

Accounts

• You must be at least 16 years old to create an account.
• Client accounts and business accounts are separate. A business account uses its own email address.
• You must give accurate information and keep it up to date. To confirm a booking you need a verified email address.
• You are responsible for keeping your password secret and for all activity in your account. Tell us at support@chekiraj.net straight away if you think someone else has accessed it.
• One person may not create multiple accounts to get around a restriction, a suspension or a deletion.
• Sessions stay signed in for up to 30 days unless you sign out.

Bookings, cancellations and attendance

• A booking is confirmed when the Platform shows it as confirmed and sends you a confirmation email.
• Each business sets its own booking and cancellation rules, which are shown on its profile and in your booking. You can cancel through your account within the time the business allows. The business is notified straight away.
• The business may change or cancel a booking. You will be notified when this happens.
• After the appointment the business can mark whether you attended. If it does not mark anything within 48 hours, the appointment counts as attended.
• If you are marked as a no-show, you are notified and can dispute it within 7 days. Our team reviews the dispute and decides. A no-show is never shown publicly.
• If an issue with a booking cannot be solved directly with the business, you can report it to us through your account.

Reviews

Only clients with an account can review a business, and only for an appointment they attended, within 14 days of the attendance being recorded. You can edit your review for 7 days after publishing it. Reviews must follow the Community and Review Guidelines. Businesses cannot delete or edit reviews. They can reply, and they can report a review they believe breaks the rules. Our team then decides.

Business accounts

This section applies if you register a business on the Platform.

• You confirm that you are authorised to act for the business and to accept these Terms on its behalf. Business subscriptions are intended for businesses and professionals, not for consumers.
• You are responsible for everything you publish: the business name, address, photos, services, prices, working hours, staff names and cancellation rules. It must be accurate, lawful and your own (or used with permission).
• You must honour bookings confirmed through the Platform, or change or cancel them in good time and with a reason, through the Platform.
• You must comply with all laws that apply to your business, including licensing, consumer protection, tax and data protection laws.
• Staff are added to the calendar without their own logins. Do not publish private phone numbers of staff. Use one business contact instead.

Subscription and trial

• Your plan is set automatically by the number of employees or resources (such as tables, rooms or courts) you enter, as shown on the pricing page. The number of bookings is not limited.
• Every plan starts with a free trial of 90 days. You do not need to enter payment details to start the trial.
• To keep your profile published after the trial, you need an active paid subscription. Subscriptions are paid monthly in advance, in euros, through PayPal, and renew automatically until cancelled. Prices for the Enterprise plan are agreed individually (marketing@chekiraj.net).
• Cancellations, refunds and failed payments are covered by the Refund and Cancellation Policy.
• We may change subscription prices. We will tell you by email at least 30 days before a new price applies to your subscription. If you do not agree, you can cancel before the change takes effect.

Sponsored placement

Businesses can buy sponsored placement for the whole business, a category or a single service, for 7, 30 or 90 days. Sponsored results are always labelled "Sponsored". Sponsorship is paid in advance and is covered by the Refund and Cancellation Policy.

How search results are ranked

Whether a business appears in the results depends on how it matches your search (category, service, text and area). The order is then decided as follows:

• Up to 3 businesses with active sponsored placement that matches the search are shown first, labelled "Sponsored". When more businesses qualify, they take turns.
• Other results are ordered by distance from the place you searched for, adjusted by rating from verified reviews: a high rating moves a business slightly up and a low rating slightly down. A rating based on only a few reviews counts less than one based on many.
• Without a place, results are ordered by rating and then by the number of reviews.

Businesses cannot pay to change their rating or to remove reviews.

Data you manage as a business

When you use the Platform, you receive and manage personal data of your clients and staff (for example names, contact details and bookings, including bookings you enter manually for clients without an account). For that data:

• You are the controller and Chekiraj is your processor. We process that data only to provide the Platform to you, according to these Terms and your use of the Platform, and not for our own purposes, except where the client is also our user (for example for their own account and bookings).
• Our staff who have access to personal data are bound by confidentiality. Access by our staff is limited to what is needed for support, moderation and security, and is logged.
• We use the sub-processors listed in the Privacy Policy and will update that list when it changes.
• We protect the data with appropriate technical and organisational measures, help you respond to requests from people whose data you hold, and inform you without undue delay if we become aware of a personal data breach affecting your data.
• When your business account is deleted, we delete the data of your business, except where we must keep it by law or where it also belongs to clients' own accounts (for example their booking history, which is kept anonymised).
• You are responsible for having a lawful basis to enter and use your clients' data, and for informing them about it.

Acceptable use

You must not:

• break the law, or use the Platform for illegal services or to deceive anyone;
• publish false, misleading, offensive or infringing content, or content that breaks the Community and Review Guidelines;
• create fake bookings or fake reviews, or manipulate ratings or search results;
• access other people's accounts or data, collect data from the Platform by automated means, or interfere with its security or operation;
• send spam or unsolicited messages through the Platform;
• resell or copy the Platform or any part of it.

Moderation, measures and appeals

We may review content that is reported to us or that we otherwise become aware of. Depending on what happened, we may edit or remove content, hide a review, ask a business to correct its profile, hide a profile from search, or impose a measure on the account: a warning, a suspension (usually for 7, 30 or 90 days) or permanent deletion. While an account is suspended, a client cannot book or review, and a business is hidden from search and cannot receive bookings.

We always tell you the reason. You can appeal any decision from your account within 10 days. The appeal is decided by our main administrator. If permanent deletion is decided and not successfully appealed, all data of the account and its business are deleted, and its email address and phone numbers are blocked from registering again.

Closing your account

• Clients can close their account at any time in the account settings. Upcoming bookings are cancelled and the businesses are notified. You can restore the account by signing in within 30 days. After that, your personal data are permanently deleted, as described in the Privacy Policy.
• Businesses can ask us to close their business account by writing to support@chekiraj.net from the account's email address.
• We may suspend or delete an account that breaks these Terms, as described above.

Intellectual property

The Platform, its design, software, texts and brand belong to Chekiraj or its licensors. You may use the Platform only as these Terms allow.

Content you publish (such as photos, descriptions, reviews and replies) stays yours. You give us a worldwide, non-exclusive, royalty-free licence to host, display, translate, adapt in format and show that content on the Platform and in its promotion, for as long as it is published on the Platform. You confirm that you have the rights needed to grant this licence.

Availability and changes to the Platform

We work to keep the Platform available and secure, but we cannot guarantee that it will always be available or free of errors. We may change, add or remove features. We will tell businesses in advance about changes that significantly affect a paid subscription.

Liability

• Chekiraj is not a party to the contract between a client and a business, and is not responsible for how the service is provided, its quality, its price or payment for it.
• We are not responsible for the content that users and businesses publish, but we act on reports as described in these Terms.
• To the extent permitted by law, we are not liable for indirect or consequential losses, such as lost profit or lost bookings. Our total liability to a business for any claim relating to the Platform is limited to the subscription fees the business paid us in the 12 months before the claim arose.
• Nothing in these Terms limits liability that cannot be limited by law, such as liability for intent or gross negligence, or the mandatory rights you have as a consumer.

Changes to these Terms

We may update these Terms. We will publish the new version on this page with its date and, for important changes, notify you by email or in your account before they apply. If you continue to use the Platform after that, the new Terms apply. If you do not agree, you can close your account.

Governing law and disputes

These Terms are governed by the laws of [буде доповнено]. Disputes are decided by the competent courts in [буде доповнено]. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in the courts there.

Languages

These Terms are available in several languages. If the versions differ, the English version prevails.
